Our goal is clearly NOT TO FIND a qualified and interested U.S. worker.
It's on video, believe it or not, and even presented as a selling point to peddle their services by Cohen & Grigsby Law Firm. That's right, this group of attorneys put an entire seminar on how to screw over the American worker on YouTube. Imagine that, a seminar from lawyers on how to make sure one doesn't have to hire an American worker!

MC, Having gone through this process somewhat, it may seem like US workers are being cheated out of jobs but usually the person on the HB1 has been on that visa for a good 7 yrs before they are even considered for a GC, especially at the moment as there are restrictions on the number of GC applications accepted.

A HB1 visa is a 7 yr visa for Skilled workers, usually people with degrees or 10 yrs of working experience in that field. If your perm application is not accepted, you have to leave the country.

After year 6, you can apply for an extension but this has to reapplied for each year until your GC application is accepted.

Because employers know you are in their hands to employ you, most HB1 visa holders are paid at a lower rate than a US worker will be and usually have higher qualifications than a US worker. The advantage of the H1 visa over the visa we were on (a L1) is that you are not tied to that employer, so if you are laid off, you have a month to find another job but then you have to go through the PERM process again. If Gordon had been laid off before we got the GC, we would had to return immediately as its a company visa.

It not unknown for HB1 visa employees to find they suddenly have to return to their home country because the PERM process has gone on too long and they have run out of extensions. Imagine living in a country for 7-10 yrs and find that you have leave within a month.

We currently have a friend who is going through the GC process who is because of a problem with his application, has just been told he has until July 21st to get an extension or he has to return to Scotland. His kids are 14 and 12 (one is a US citizens)who have only briefly lived in Scotland. The reason they are over here is because the plant he worked in Germany was closed down and the only place left was here.

I do have a lot of sympathy with US employees as they have very little workers protection but then again my husband who works with a number of US engineers, says lot of them are pretty useless.
